| (k) Relationship with Apothecare | This company supplies Platform orders exclusively as Apothecare's agent under the Supply and Fulfilment Agency Agreement between the two companies, and does not sell on its own behalf on the Platform. Apothecare is the seller in relation to every supply from this location. |
3.1 Every Fulfilment Location operates under a prior written arrangement with Apothecare, being, for Apothecare's own premises, its own operating procedures and, for premises operated by another person, the Supply and Fulfilment Agency Agreement. Under that arrangement every Fulfilment Location undertakes:
4.1 Every complaint arising out of an order placed on the Platform, whichever Fulfilment Location supplied it, is addressed to Apothecare and dealt with by Apothecare. The Grievance Officer is Sri Sunil Kumar S, Director and Chief Executive Officer, ceo@apothecare.in, +91 63649 03613, Monday to Saturday between 10:00 and 18:00 IST. Customer care is available at customersupport@apothecare.in and +91 63638 26363.
4.2 Every complaint is acknowledged within twenty-four hours of receipt and resolved within fifteen days, and in any event within the forty-eight hours and one month prescribed by Rule 4(5) of the Consumer Protection (E-Commerce) Rules, 2020. A ticket number is generated on acknowledgement.
5.1 Where a Fulfilment Location is operated by a person other than Apothecare, that person acts solely as Apothecare's agent for the supply of the goods, on Apothecare's behalf and under its authority. The customer's contract of sale is made with Apothecare Specialities Private Limited and with no one else, and Apothecare is answerable to the customer for the goods and for the order.
5.2 The tax invoice raised by an agent is raised under the agent's own Goods and Services Tax registration for the State from which the order is despatched, so that a local supply carries a local tax invoice. Every such invoice states on its face that the goods are supplied as agent for and on behalf of Apothecare Specialities Private Limited, who is the seller. The invoice being raised by the agent does not make the agent the customer's seller and does not affect any right the customer has against Apothecare.
6.1 The allocation of an order between the Fulfilment Locations named in Section 2 is automatic. No parameter of allocation is commercial. No Fulfilment Location receives preference by reason of ownership, common control, fee or any other arrangement, and the price payable is the same whichever Fulfilment Location fulfils the order.
6.2 The parameters of allocation, in the order in which they are applied, are:
6.3 Where an order is placed from a State not listed in Section 2.2(j), or where the product ordered is not held at the Hyderabad Fulfilment Location, the order is allocated to the Bengaluru Fulfilment Location.
7.1 Stock is supplied by Apothecare to the operator of a Fulfilment Location for the purpose of the agency, supported by the documents required under the Drugs and Cosmetics Rules, 1945 and under the law relating to Goods and Services Tax. That movement is internal to the supply chain, is not a sale to the customer, and does not affect the customer's contract with Apothecare.
8.1 This Schedule may be amended by publishing a revised version bearing a higher version number and a fresh effective date. The version in force when an order is placed governs that order.
