Hello!
Apothecare Specialities Private Limited
Version 1.0 | Effective from 05.10.2026
1. These Terms govern your use of www.apothecare.in and every purchase made through it ("the Platform"). The Platform is owned and operated by Apothecare Specialities Private Limited, Corporate Identity Number U47720KA2025PTC204484, Goods and Services Tax Identification Number 29ABDCA1724E1Z0, registered office at 1st Floor, No. 63, M S Ramaiah Road, Gokula Extension, Mathikere, Bengaluru – 560 054, Karnataka ("Apothecare", "we", "us").
2. Apothecare holds licences under the Drugs and Cosmetics Act, 1940 and the Drugs and Cosmetics Rules, 1945 in Form 20, Form 20-B, Form 21 and Form 21-B bearing Nos. KA-B12-279698, KA-B12-279699, KA-B12-279700, KA-B12-279701, valid from 07.07.2025 to 06.07.2030. Its Registered Pharmacist and Qualified Person is Sri Sunil Kumar S, Karnataka State Pharmacy Council Registration No. RP-50844.
3. Apothecare supplies from more than one licensed location so that your order reaches you quickly. Your order is fulfilled from the licensed location allocated to it under paragraph 11 ("the Fulfilment Location").
4. In short: you buy from Apothecare, wherever your parcel comes from. Apothecare is the seller of every order placed on the Platform, whichever Fulfilment Location fulfils it. Your contract of sale is made with Apothecare Specialities Private Limited and with no one else, and Apothecare is answerable to you for the goods and for the order.
5. Where the Fulfilment Location is operated by a company other than Apothecare, that company acts solely as Apothecare's agent for supplying the goods, on Apothecare's behalf and under its authority. Section 226 of the Indian Contract Act, 1872 provides that contracts entered into through an agent, and obligations arising from acts done by an agent, may be enforced in the same manner and have the same legal consequences as if entered into and done by the principal in person.
6. Your tax invoice may be raised by that agent under its own Goods and Services Tax registration for the State from which your order is despatched, so that a local supply carries a local tax invoice. Every such invoice states on its face that the goods are supplied as agent for and on behalf of Apothecare Specialities Private Limited, who is the seller. The invoice being raised by the agent does not make the agent your seller and does not affect any right you have against Apothecare.
7. The Fulfilment Locations presently in operation, and the company operating each, are listed in the Fulfilment Locations Schedule published on the Platform, which forms part of these Terms. A Fulfilment Location may be added or removed by amendment of that Schedule alone.
8. Apothecare owns the inventory offered on the Platform and sells it directly to you. It is accordingly an inventory e-commerce entity within the meaning of the Consumer Protection (E-Commerce) Rules, 2020 in respect of every order, and every duty and liability under Rule 7 of those Rules lies on Apothecare. The Platform is not a marketplace and no person other than Apothecare sells on it.
9. Apothecare vouches for the authenticity of every product offered on the Platform, whoever supplies it. Rule 7(5) of the said Rules provides that an inventory e-commerce entity which explicitly or implicitly vouches for the authenticity of the goods sold by it, or guarantees that such goods are authentic, shall bear appropriate liability in any action relating to authenticity. Apothecare accepts that liability in relation to every product offered on the Platform and does not seek to place it upon the Fulfilment Location as against you.
10. Every complaint, return, refund and claim is to be addressed to Apothecare's Grievance Officer and will be dealt with by Apothecare. You are not required to identify or to approach any other person.
11. There is only one seller on the Platform and no ranking of sellers arises. Allocation of your order between Apothecare's Fulfilment Locations is automatic, is disclosed here for transparency, and is determined by the following parameters in the following order:
12. No parameter of allocation is commercial. No Fulfilment Location receives preference by reason of ownership, common control, fee or any other arrangement, and the price you pay is the same whichever location fulfils your order.
13. Stock is supplied by Apothecare to the operator of a Fulfilment Location for the purpose of the agency, supported by the documents required under the Drugs and Cosmetics Rules, 1945 and under the law relating to Goods and Services Tax. That movement is internal to the supply chain, is not a sale to you, and does not affect your contract with Apothecare.
14. By using the Platform or placing an order you accept these Terms, the Fulfilment Locations Schedule, the Cancellation, Returns and Refund Policy, the Prescription Verification Policy, the Grievance Redressal Policy, the Disclaimer and Medical Information Policy, the IP and Brand Usage Policy and the Notice and Take-down Policy. The Privacy Policy and the Cookie Policy explain how personal data is handled; you are not asked to accept them as terms of contract.
15. Your consent to the processing of your personal data is not given by accepting these Terms. It is taken separately, by a distinct affirmative action, on the Consent Notice presented at the point of collection, in the manner contemplated by Section 5 of the Digital Personal Data Protection Act, 2023 read with Rule 3 of the Digital Personal Data Protection Rules, 2025, which Apothecare observes ahead of the date on which those provisions come into force.
16. You must have completed eighteen years of age and be competent to contract under Section 11 of the Indian Contract Act, 1872. Registration requires a declaration to that effect, which is a self-declaration and not a verification.
17. Medicines specified in Schedule H and Schedule H1 to the Drugs and Cosmetics Rules, 1945 are dispensed only against, and strictly in accordance with, the prescription of a registered medical practitioner, as required by Rule 65(9)(a) of those Rules.
18. The prescription you upload is verified by the Registered Pharmacist at the Fulfilment Location allocated to your order, and by no one else, because it is at those premises that the medicine is dispensed. Your order is not despatched until that verification is recorded as complete. Where allocation changes after verification, the order is verified afresh at the new location.
19. The supply of a Schedule H1 medicine is recorded in a separate register giving the name and address of the prescriber, the name of the patient, the name of the drug and the quantity supplied. That register is maintained for three years and is open to inspection, as Rule 65(3)(h) requires. It is kept by the holder of the licence for the premises from which the medicine is dispensed.
20. The Registered Pharmacist may decline to dispense where the prescription is illegible, altered, expired, apparently not genuine, or where in his professional judgment dispensing would not be safe or lawful. Any amount paid is refunded in full.
21. Medicines specified in Schedule X to the said Rules are not offered on the Platform.
22. No product is supplied from premises for which a subsisting licence covering that product is not held. A licence under the said Rules is granted in respect of specified premises and does not extend across State boundaries. No location appears on the Fulfilment Locations Schedule until its licences are on record.
23. Section 3 of the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 prohibits any person from taking part in the publication of an advertisement referring to a drug in terms which suggest, or are calculated to lead to, its use for the procurement of miscarriage or the prevention of conception in women, for the maintenance or improvement of the capacity of human beings for sexual pleasure, for the correction of menstrual disorder in women, or for the diagnosis, cure, mitigation, treatment or prevention of any disease, disorder or condition specified in the Schedule to that Act. Section 7 makes contravention punishable, on a first conviction, with imprisonment which may extend to six months, or with fine, or with both. No product is listed on the Platform in terms falling within that Section.
24. Apothecare is responsible for the accuracy of the descriptions, images and other content on the Platform, and every operator of a Fulfilment Location is bound by contract to supply goods conforming to them.
25. Every promotional claim on the Platform is supported by evidence held on Apothecare's claims substantiation register. Consistently with the Guidelines for Prevention of Misleading Advertisements and Endorsements for Misleading Advertisements, 2022 issued by the Central Consumer Protection Authority on 09.06.2022, a disclaimer is used only to expand, clarify or qualify a claim, and never to contradict it, to conceal material information about it, or to correct a claim which is itself misleading.
26. Content on the Platform is general information. It is not medical advice, is not a diagnosis and is not a substitute for consultation with a registered medical practitioner. You must not commence, alter or discontinue any treatment on the basis of it.
27. The display of a product is an invitation to offer; your order is an offer; the contract is concluded when the order is despatched by or on behalf of Apothecare or, for a prescription medicine, when the prescription has been verified and the order despatched.
28. Prices are in Indian Rupees and are shown as a single figure total together with a breakup showing all compulsory and voluntary charges, including delivery, postage and handling and conveyance charges and the applicable tax. Prices never exceed the maximum retail price printed on the pack.
29. The price is the same whichever Fulfilment Location is allocated to your order. You are not charged more because your order is despatched from one location rather than another.
30. If a pricing or description error is discovered before despatch, the order may be cancelled and refunded in full, and will not be delivered at an erroneous price where the error ought reasonably to have been apparent to you.
31. Payment is collected through the gateways of Razorpay, Cashfree and PhonePe. Payment is collected on the Platform for Apothecare and is accounted against the tax invoice raised for your order. Neither Apothecare nor any Fulfilment Location receives or stores your card number, card verification value or banking credentials.
32. Delivery is available at the pincodes listed on the Platform, through the logistics partners Bluedart, Tirupati, Maruti, DTDC and Professional Courier.
33. Transit times shown are those indicated by the logistics partner concerned. They are indicative estimates and not a guarantee, and Apothecare remains responsible to you for the delivery obligation itself.
34. Medicines requiring refrigerated or controlled storage are despatched only to pincodes at which the storage conditions stated on the manufacturer's labelling can be maintained in transit, and in packaging suited to those conditions.
35. These are governed by the Cancellation, Returns and Refund Policy, which forms part of these Terms. The obligation to take back goods and to refund lies on Apothecare. Where a Fulfilment Location operated by an agent accepts a return or makes a refund, it does so on Apothecare's behalf.
36. Apothecare is the Data Fiduciary in respect of all personal data processed through the Platform. It alone determines the purpose and means of that processing.
37. When your order is allocated, Apothecare makes available to the operator of the Fulfilment Location the personal data necessary for it to dispense and deliver. That operator processes it as a Data Processor on Apothecare's documented instructions under a written contract, and is a Data Fiduciary in its own right only in respect of the registers it must keep as licensee. The Privacy Policy sets this out in full.
38. You may exercise against Apothecare, which answers you directly, the rights described in Sections 11 to 14 of the said Act. Apothecare honours those rights ahead of their commencement, as the Privacy Policy explains.
39. Nothing in these Terms requires you to waive any right under the said Act, and any purported waiver is invalid to the extent of the infringement, as Section 6(2) provides. You owe duties under Section 15 of that Act, which include not impersonating another person and furnishing only such information as is verifiably authentic.
40. The Platform and its contents belong to Apothecare or are used by it under licence and may not be copied, reproduced or exploited without written permission.
41. The mark "Apothecare" and the Apothecare device are used as trade marks. Applications in respect of marks in that family stand in the name of the predecessor firm M/s Apothecare Wellness, of which Application No. 4998652 in Class 35, filed on 09.06.2021, is one.
42. Until a certificate of registration is produced for a given mark and class, and until the register records the proprietor, the symbol ™ is used and the symbol ® is not. Section 107(1) of the Trade Marks Act, 1999 prohibits a representation that an unregistered mark is registered, or that a registered mark is registered for goods or services for which it is not in fact registered; Section 107(3) deems the use of the word "registered" or of any expression, symbol or sign referring expressly or impliedly to registration to import a reference to registration in the register; and Section 107(2) makes contravention punishable with imprisonment which may extend to three years, or with fine, or with both.
43. The operator of a Fulfilment Location may use the Apothecare marks only to the extent permitted by its written agreement with Apothecare, only in a manner which makes clear that it acts as agent, and for no other purpose.
44. Third-party brand names appearing on the Platform are used only to identify the goods of their proprietors, lawfully acquired and resold. No association, sponsorship, authorisation or distributorship is claimed or to be inferred.
45. You may not use the Platform to obtain medicines otherwise than for bona fide personal or household use; resell anything purchased on it; attempt unauthorised access; introduce malicious code; or scrape, index or extract its data by automated means.
46. The Platform is provided on an "as is" basis and is not warranted to be uninterrupted or error-free.
47. Nothing limits Apothecare's liability under Rule 7(5) of the said Rules of 2020, which provides that an inventory e-commerce entity which explicitly or implicitly vouches for the authenticity of the goods sold by it shall bear appropriate liability in any action relating to authenticity, and which Apothecare accepts. Nor does anything limit its responsibility under Section 8(1) of the Digital Personal Data Protection Act, 2023, which is not capable of being displaced by agreement. Subject to that, the aggregate liability in respect of any order shall not exceed the amount paid by you for that order.
48. Apothecare is not liable for any delay or failure caused by an event beyond its reasonable control.
49. Apothecare's Grievance Officer is Sri Sunil Kumar S, Director and Chief Executive Officer, ceo@apothecare.in, +91 63649 03613, available Monday to Saturday between 10:00 and 18:00 IST, and at the registered office. The Deputy Grievance Officer is Sri Gopal, Business Head, gopal@apothecare.in, +91 63649 03412. The nodal person of contact under Rule 4(1)(b) of the said Rules is Sri Sreekakula Sankara Narayana, Director. The person able to answer questions about the processing of personal data, designated voluntarily as Data Protection Officer, is Smt. Pushpa S, privacy@apothecare.in.
50. Customer care is available at customersupport@apothecare.in and +91 63638 26363. Every complaint is dealt with by Apothecare.
51. A ticket number is generated for every complaint lodged, by which you may track its status, as Rule 7(1)(f) of the said Rules requires. Every complaint is acknowledged within twenty-four hours of receipt and resolved within fifteen days, and in any event within the forty-eight hours and one month prescribed by Rule 4(5) of the said Rules. The Grievance Redressal Policy sets out the shorter periods that apply to complaints about content on the Platform.
52. The legal name, registered office address, website particulars and customer care and grievance contact details of Apothecare are displayed on the Platform in accordance with Rule 4(2) of the said Rules.
53. Nothing in these Terms restricts your right to approach a Consumer Commission of competent jurisdiction under the Consumer Protection Act, 2019, or the Data Protection Board of India under the Digital Personal Data Protection Act, 2023.
54. These Terms are governed by the laws of India. Subject to your statutory rights as a consumer to institute proceedings before the Consumer Commission within whose jurisdiction you reside or personally work for gain, and subject to the jurisdiction of the Data Protection Board of India, the courts at Bengaluru, Karnataka shall have jurisdiction.
55. These Terms may be amended. The version number and effective date are updated on each amendment, and the Terms in force when your order is placed govern that order.
