Hello!
Apothecare Specialities Private Limited
Version 1.0 | Effective from 05.10.2026
This Policy explains how Apothecare Specialities Private Limited ("Apothecare", "we", "us") deals with prescriptions for orders placed on www.apothecare.in ("the Platform"), and when it will and will not supply a medicine. It forms part of the Master Terms and Conditions.
1. The principle is simple: no medicine which the law requires to be supplied against a prescription is supplied by us without one, and no such prescription is acted upon until a Registered Pharmacist has examined it.
2. This Policy is issued under the Drugs and Cosmetics Act, 1940 and the Drugs and Cosmetics Rules, 1945, in particular Rule 65, under clause (9)(a) of which drugs specified in Schedule H and Schedule H1 are sold by retail only on, and in accordance with, the prescription of a Registered Medical Practitioner.
3. A prescription is required for every drug specified in Schedule H and Schedule H1 to the Drugs and Cosmetics Rules, 1945, and for every other drug which may lawfully be supplied only against a prescription. Listings for such products are clearly marked on the Platform as requiring a prescription on the product page, category page, and cart.
4. We do not supply drugs specified in Schedule X, nor narcotic or psychotropic substances, nor any drug falling outside the licences held for the premises from which the order is dispensed.
5. A prescription furnished to us must show the following particulars:
6. The prescription must be completely legible in the uploaded copy (a clear photograph is acceptable if every detail can be read). A prescription for a Schedule H1 drug must additionally satisfy all statutory requirements and is recorded in a separate register under Rule 65(3)(h).
7. Every prescription is examined before dispensing by the Registered Pharmacist at the Fulfilment Location from which your order is to be dispensed. At Bengaluru, the Registered Pharmacist is Sri Sunil Kumar S, Karnataka State Pharmacy Council Registration No. RP-50844, or another qualified Registered Pharmacist engaged at those premises.
8. The Registered Pharmacist verifies that all prescription requirements are met, that the product ordered corresponds in name, strength, and form, that the quantity ordered is supported, and that the prescription has not expired or been exhausted.
9. The verification decision (approved, refused, or clarification sought) is recorded against the order with the identity of the pharmacist, date, and timestamp as part of our audit trail. No order for a prescription medicine is despatched until verification is complete. Where payment has been taken and supply is declined, we refund in full.
10. Where an order is allocated to a different Fulfilment Location after verification, it is verified afresh by the Registered Pharmacist at that location before despatch.
11. Clarification: We may contact you, or with your consent the prescribing practitioner, where the prescription is unclear, the drug/strength is ambiguous, the quantity appears disproportionate, or the ordered product does not match what was prescribed.
12. Refusal: We shall refuse to supply where the prescription is illegible, incomplete, undated, unsigned, expired, altered, or apparently not genuine; where the quantity exceeds what it supports; where the prescription is exhausted; where the drug cannot lawfully be supplied from the premises; or where the Registered Pharmacist forms a professional view that supply would not be safe or lawful.
13. A refusal is not a personal judgment. When we refuse, we provide the reason and refund any payment taken. Where a prescription appears forged or altered, we may retain a copy and report the matter to the appropriate authorities.
14. A prescription may be dispensed more than once only where it so permits and only to the extent the Drugs and Cosmetics Rules, 1945 allow for the drug concerned. Prescriptions for Schedule H1 drugs are not repeated except as permitted by those Rules. We do not operate automated or subscription-based repeat supply for prescription medicines.
15. Account holders must be 18 years of age or older. Where the patient is a child or someone unable to place the order personally, the account holder confirms they are the parent, lawful guardian, or authorised representative, and the prescription must name the actual patient.
16. You warrant that every prescription uploaded is genuine, issued to the named patient, and un-altered. You must not upload another person's prescription for your own use.
17. Prescriptions constitute sensitive health data and are protected as detailed in our Privacy Policy. Prescriptions and prescription registers are preserved for 3 years, and Schedule H1 registers are maintained for 3 years as required under Rule 65(3)(h) and Rule 65(7) of the Drugs and Cosmetics Rules, 1945.
18. Verification is a dispensing check and does not constitute medical advice. For clinical guidance, please consult your treating physician.
