Apothecare Specialities Private Limited
Version 1.0 | Effective from 05.10.2026
This IP and Brand Usage Policy explains how Apothecare Specialities Private Limited respects, uses, and protects intellectual property rights, whether belonging to manufacturers of the products it distributes, to other third parties, or to itself, in connection with the Platform. It forms part of the Master Terms and Conditions.
1.1 The Company owns, or holds valid licences for, all intellectual property in the Platform, including the name "Apothecare", device marks, user interface, layout, source code, medical and editorial content, and the compilation of its product database.
1.2 Users receive a limited, revocable, non-exclusive, non-transferable licence solely to access, browse, and purchase products on the Platform. Users may not scrape, mirror, frame, reverse engineer, or create derivative works from the Platform.
2.1 All trademarks, brand names, product packaging artwork, and logos of third-party products (such as Wegovy, Ozempic, Mounjaro, and other specialty pharmaceuticals) belong exclusively to their respective manufacturers.
2.2 Apothecare's use of manufacturer trademarks is strictly descriptive and nominative to enable users to identify and purchase genuine, lawfully acquired stock in reliance upon Section 30(1), Section 30(2)(c), and Section 30(3) of the Trade Marks Act, 1999. Apothecare does not deal in impaired goods (Section 30(4)), ensuring strict cold-chain compliance.
2.3 Apothecare disclaims any affiliation, endorsement, sponsorship, or joint venture with brand owners unless expressly stated under written contract.
3.1 We display manufacturer marks with correct spelling, accurate symbols (®/™), authentic packaging imagery, and without distorted graphics or superimposed Apothecare watermarks.
3.2 The Company prohibits using manufacturer trademarks as hero banners, push notification headlines, or surrogate advertisements, especially for Schedule H, H1, and X prescription medications in compliance with the Drugs and Magic Remedies Act, 1954.
4.1 When you submit reviews, ratings, or comments, you grant Apothecare a royalty-free, perpetual, worldwide licence to use and publish that content.
4.2 You warrant that your content does not infringe third-party rights, is not defamatory or misleading, and does not make unsubstantiated medical claims.
5.1 Brand owners with questions or concerns regarding IP display may write to legal@apothecare.in with proof of ownership, specific listing URLs, and grounds of objection.
5.2 All formal infringement complaints and counter-notices are handled under our Notice and Take-down Policy.
